TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Registration and entry in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Harris Farm Markets () of Warehouse W, Sydney Markets, Flemington NSW 2129 (“the Promoter”).
  3. Promotion commences at 12am AEST Wednesday 11 February 2015 and closes at 11.59pm AEST Friday 20 February 2015 (“Promotion Period”). Entries received outside the promotion period will not be accepted.

Conditions of entry

  1. To be eligible to enter and win (“Eligible Entrant”), entrants must be over the age of 16 years and be employed by Harris Farm Markets for the promotion period and for the prize draw.

The Prize

  1. An Eligible Entrant will be eligible to win one (1) prize on offer. There is only one (1) prize in total to be won by one (1) winner.
  2. There is a total of one (1) prize:
    1. The winner will receive one (1) Hamilton Island Holiday prize, consisting of:
  3. Two (2) return flights from Sydney to Hamilton Island Australia, Qantas Airlines or Virgin Australia with Economy Class. (This includes all flight associated taxes).
  4. Five (5) nights accommodation at the Palm Bungalows Hamilton with full buffet breakfast for two (2) people. Unlimited use of scheduled 'Island Shuttle’ service, Complimentary use of non-motorised watersports.
  • AU $500 value spending money which will be deposited into the prize winners nominated bank account.

 

  1. Total Prize value has a maximum retail value of AU$3010 (including GST)

 

  1. Travel must be on Qantas Airways services or Virgin Australia and completed within 12 months of the winner being notified that they have won the prize with no extensions.

 

  1. Booking of flights and accommodation are subject to availability. Travel is for a period of no more than 5 days and any tickets which remain unused after the expiry date shall be deemed null and void. The flight tickets are subject to availability and travel during peak periods and embargo periods may be restricted. This includes, but is not limited to July and August and the Christmas/New Year period. Accommodation exclusion dates are August 15 -23, 2015 and 23 Dec 2015 - 6 January 2016.
  1. Any other expenses on the holiday and meals that are not included in the prize package are at the winner’s expense.
  2. Tickets are non-transferable, non-refundable and non-redeemable for cash or other goods or services.
  3. At least one (1) of the travellers must be over 18 years of age.
  4. Date changes once booked are not permitted and any additional nights’ accommodation is at the expense of the winner.
  5. Prize must be booked as a package.
  6. All bookings must be made via Morph Communications Pty Ltd, PO Box 2113, Clovelly West, 2031 NSW, Australia, further contacts details provided to the winner.

 

 

How to Enter

  1. To enter the competition Eligible Entrants must during the Promotion Period:
    1. Complete the entry form and questions distributed by Harris Farm Markets stores and provide the following (text fields provided in entry form):
      1. Full Name
      2. Email Address

  1. Answer all of the multiple choice questions correctly
  1. Only entries with all of the multiple choice questions answered correctly will be valid and eligible for the competition.
  2. Eligible Entrants must agree to terms and conditions and to being contacted by the Promoter in conjunction with this competition.
  3. Entry forms to submitted to the store or operations manager.

 

Winner Selection

  1. The winners will be selected at random at approximately 12.00pm AEST Tuesday 24th February 2015 at Harris Farm Markets Warehouse W, Sydney Markets, Flemington NSW 2129. The first correct entry drawn at random will be the winner.
  2. This is a game of chance.

Winner Notification

  1. Winners name will be published in in-store communication by Harris Farm Markets on Tuesday 24th Feb 2015
  2. Prizes will be awarded to the person named on the application form as per clause 17 (b).
  3. In the event the main Prize winner is unable to accept the prize by 12pm AEST Friday 20 May 2015, a redraw will happen. The redraw will be held on 21 May 2015 at 11am at Harris Farm Markets Warehouse W, Sydney Markets, Flemington NSW 2129.The Eligible Entrant with the next randomly drawn entry will be deemed the new winner of the prize. The Eligible Entrant that is deemed the new winner will be notified on 22 May 2015 by email. Winners name will be published in in-store communication by Harris Farm Markets on 23 May 2015.

 

General Conditions

  1. The prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by The Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  2. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
  3. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
  4. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Eligible Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
  5. The Promoter is not responsible for any problems or technical malfunction of any computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof related to or resulting from participation in this competition.

 

  1. It is a condition of acceptance of the prize that the winning Eligible Entrant is a current employee of Harris Farm Markets Australia.

 

  1. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. This includes, but is not limited to, meals, taxes, insurances, transport to and from departure point, transfers to and from the venue, items of a personal nature, in-room charges and all other ancillary costs are not included.

 

  1. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

 

  1. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

 

  1. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with The Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

 

  1. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

 

  1. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

 

  1. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

 

  1. Should an Eligible Entrant’s contact details change during the Promotional Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.

 

  1. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

 

  1. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

 

  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

 

  1. The Promoter and their related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

 

  1. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

 

  1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

 

  1. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

 

  1. If for any reason this competition is not capable of running as planned, including any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

 

  1. If required, Eligible Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

 

  1. No responsibility is accepted for late, lost or misdirected entries.
  2. Incomplete or indecipherable entries will be deemed invalid

 

 

 

Privacy Consent

 

  • The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting harrisfarm.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
     
  • As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
